Jalaan's - Terms of Use & Service Agreement
I. Introduction & Binding Terms
Welcome to Jalaan's. This website, mobile-optimized interface, localized digital catalog, and all virtual or physical assisted commerce channels, collectively referred to as the "Platform", are owned and operated by Jalaan's, managed by Jalan's G.De Jewellers unit Vija Exports & Handicraft Pvt Ltd, a company incorporated under the provisions of the Companies Act, 1956.
By accessing, browsing, registering an account, utilizing our WhatsApp concierge, booking video shopping appointments, or executing a transaction on this Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use, including our integrated Privacy Policy, Return Guidelines, and Buyback Framework.
If you do not agree with any part of these terms, you are directed to immediately cease all utilization of the Platform. These terms constitute an electronic record in terms of the Information Technology Act and the rules framed thereunder, as applicable, and do not require any physical or digital signatures.
II. Eligibility & User Accounts
Use of the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are incompetent to contract, including undischarged insolvents and minors, are not eligible to use the Platform. If you are under the age of 18 years, you shall not register as a user or transact on the Platform. Jalaan's reserves the right to terminate access if it is discovered that you are under 18 years of age.
If you create a registered profile, you are solely responsible for maintaining the confidentiality of your display name, user ID, and password. If you provide information that is untrue, inaccurate, misleading, or incomplete, or if we have reasonable grounds to suspect the same, we may suspend, terminate, or block access to your membership on the Platform.
III. Privacy Policy & Data Handling
By interacting with our Platform, you authorize Jalaan's to collect, store, process, and utilize your personal and transactional information in compliance with applicable data protection frameworks in India.
We collect names, billing addresses, delivery addresses, email addresses, and active phone numbers required to authenticate and deliver high-value orders. Financial assets are handled through secure third-party payment gateways. Digital images, custom files, and communication logs exchanged through video shopping sessions, WhatsApp business tools, or customer support lines may be archived for quality assurance, verification, and custom design accuracy.
Jalaan's does not sell, rent, trade, or maliciously exploit your personal data with third parties. Your data is restricted to internal operations, logistics handling by insured courier partners, and compliance protocols enforced by government authorities. We implement industry-standard encryption protocols to protect our systems against external cybersecurity threats.
IV. Chat & Consultation Services
Jalaan's offers interactive chat tools, WhatsApp business interfaces, and real-time video shopping call facilities, collectively called "Communication Services", to provide guided recommendations, showroom inventory access, and product explanations. Advice, product assessments, or styling tips provided through these services are for informational purposes only. Jalaan's disclaims liability for purchases made relying solely on conversational statements.
By initiating a virtual chat or video call, you consent to monitoring, logging, or recording of the session for quality control, security, and verification purposes. Abusive, defamatory, profane, obscene, or harassing language with our digital concierge or showroom staff is strictly prohibited. Jalaan's may terminate any chat or call, block your phone number or IP address, and take legal action if behavior is deemed hostile or fraudulent.
V. Pricing & Product Disclaimers
We make every possible effort to display the colors, textures, carvings, and dimensions of our products, including fine diamond jewellery, 925 sterling silverware, devotional murtis, and 999 gold or silver coins, as accurately as possible. However, screen calibration may alter visual output, and Jalaan's does not warrant that the physical product delivered will visually match the rendering on your screen with 100% precision.
Because our products involve hand-crafted metallurgical engineering, minor variances in final product weight, within standard industrial tolerances, may occur during casting and polishing.
Precious metals, including gold, silver, and diamond, are volatile commodities tied to global market pricing. Jalaan's updates product pricing dynamically and reserves the right to modify retail pricing without prior notice. If an item is listed at an incorrect price due to typographical error, technical data feeds, or operational oversight, Jalaan's may cancel any order placed for that product. In such cases, a complete refund or shopping voucher of the transacted amount will be issued.
VI. Return & Exchange Policy
Due to the high-value nature of precious diamonds, authenticated gold, and certified sterling silver, and to ensure the purity of every piece leaving our vaults, Jalaan's operates under a strict, non-negotiable No-Return and No-Exchange policy.
Once an item is sold and delivered, the sale is final. We do not accept items back under any circumstances, including change of mind, situational reversals, or personal design preference shifts.
Every item undergoes strict, multi-layered quality control and is certified before being packed inside tamper-evident logistics boxes. Customers are instructed to refuse delivery if the outer secure shipping box shows structural damage or broken courier seals. Acceptance of delivery waives subsequent claims of structural transit damage or external tampering.
VII. Buyback Policy
As a legacy multi-generational firm built on trust, we stand behind the intrinsic value and certified purity of our products. While standard commercial returns are strictly prohibited, we provide a formal pathway for long-term valuation liquification through our corporate buyback policy.
If you wish to liquidate or trade in authentic Jalaan's precious metals or diamond articles at prevailing market valuation rates, you must contact our specialized evaluation division directly. Do not use the automated e-commerce interface for buyback queries. Final execution of a buyback transaction remains at the sole discretion of Jalaan's management.

VIII. Site Security & Prohibited Uses
Jalaan's employs multi-layered security protocols to safeguard user data, payment transactions, and intellectual properties. Users are prohibited from violating or attempting to violate Platform security, including accessing data not intended for such user, logging into unauthorized servers or accounts, probing or testing system vulnerability, breaching authentication measures, interfering with service, submitting malicious code, overloading, flooding, spamming, mailbombing, crashing, or sending unsolicited promotional email.
Violations of system or network security may result in civil and criminal liability under the Information Technology Act and other relevant statutes. Jalaan's may investigate such violations and cooperate with law enforcement authorities in prosecuting users involved in malicious platform breaches.
IX. Account Termination
These Terms of Use remain effective unless and until terminated by either you or Jalaan's. Jalaan's reserves the right, in its sole discretion and without prior notice or liability, to terminate or suspend your account, restrict access to all or part of the Platform, or cancel pending orders if we determine or suspect that you have violated these Terms, your actions pose a financial, legal, or security risk, or you engage in fraudulent chargebacks, extortion attempts, or defamatory activities against the brand.
Upon termination, you must promptly destroy all materials downloaded or otherwise obtained from this Platform, as well as all copies. Our rights to any user content shall survive termination. Termination shall not affect your obligation to pay for products already ordered or any liabilities that arose prior to termination.
X. Intellectual Property
All content on this Platform, including trade names, custom logos, stylized brand signatures, editorial lookbooks, styling photography, product descriptions, video files, text graphics, website source code, layout wireframes, user interfaces, database structures, and software code, is the exclusive intellectual property of Jalaan's and is protected under applicable Indian and international copyright, trademark, and patent statutes.
You are granted a limited, non-exclusive, non-transferable, revocable license to access the Platform strictly for personal, non-commercial shopping purposes. You are expressly prohibited from using automated bots, spiders, deep-links, page-scrapes, or web-crawlers to monitor, index, copy, extract data, or harvest pricing models from our Platform.
XI. Limitation of Liability
You explicitly agree that your use of, or inability to use, the Platform is at your sole risk. The Platform and all products delivered through it are provided "as is" and "as available", without representation, warranties, or conditions of any kind, either express or implied.
To the maximum extent permitted by law, the total aggregate liability of Jalaan's to you for any claim, action, lawsuit, or dispute shall never exceed the exact net retail amount collected by us in the specific transaction giving rise to the liability.
XII. Force Majeure
Jalaan's shall be released from liability, penalty, or failure to perform operational duties, including shipment delays, custom manufacturing cancellations, or platform downtime, caused by an event beyond our reasonable control. This includes acts of God, floods, severe weather emergencies, pandemics, public health quarantines, civil lockouts, cyberterrorism, server hosting failures, or unexpected legislative amendments affecting the distribution of diamonds, gold, or silver in the domestic market.
XIII. Entire Agreement
These Master Terms of Use, along with the integrated Privacy Policy, Shipping Policy, and any other explicit legal notices or transactional invoices published by Jalaan's on the Platform, constitute the complete and exclusive agreement between you and Jalaan's regarding your use of the Platform and purchase of products.
This document supersedes all prior or contemporaneous communications, agreements, representations, promises, or understandings between you and Jalaan's. No modification, amendment, or waiver of any provision of these Terms by the customer shall be valid or binding unless executed in writing and signed by authorized personnel of Jalaan's.
XIV. General Provisions
The failure of Jalaan's to exercise or enforce any right, power, or provision of these Terms shall not operate as a waiver of such right, power, or provision. Any waiver of a breach must be issued explicitly in writing by Jalaan's management.
Nothing in these Terms shall be construed as creating any agency, partnership, joint venture, or other form of joint enterprise between you and Jalaan's. Neither party has authority to bind the other in any manner. Headings and section markers are inserted solely for organizational convenience and shall not affect legal interpretation or enforceability.
XV. Governing Law & Jurisdiction
These Master Terms of Use, along with all operational policies and transactional interactions between you and Jalaan's, shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, arbitration proceedings, consumer litigation, or judicial action against Jalaan's or its affiliates arising out of these Terms shall be filed exclusively in the competent courts located in New Delhi, India.
If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, void, invalid, or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed, and the remaining provisions shall continue in full force.
